The African Democratic Congress (ADC) has filed an appeal against the judgment of the Federal High Court in Abuja in a suit involving Hon. Nafiu Bala Gombe, asking the Independent National Electoral Commission (INEC) to suspend further action on the matter pending the determination of the appeal.
The party's counsel, S. E. Aruwa, SAN & Co., disclosed this in a letter dated November 6, 2026, addressed to the INEC Chairman and received at the commission's headquarters in Abuja on the same day.
The letter, titled Notice of Pendency of Notice of Appeal and Application for Stay of Execution, concerns Suit No. FHC/ABJ/CS/1619/2025 between Hon. Nafiu Bala Gombe and the ADC and four other defendants.
According to the letter, the Federal High Court, Abuja Judicial Division, delivered judgment in favour of the plaintiff on November 5, 2026.
Dissatisfied with the decision, the ADC filed a Notice of Appeal at the Court of Appeal on November 6, challenging the judgment.
The party also filed a Motion on Notice at the Federal High Court, seeking a stay of execution of the judgment pending the hearing and determination of the appeal.
However, the legal representatives clarified that the application for a stay of execution was yet to be considered by the court.
The lawyers informed INEC that Hon. Nafiu Bala Gombe, the plaintiff in the case, had been notified of both the appeal and the application for a stay of execution.
Consequently, the ADC urged INEC to suspend further action on the subject matter of the suit pending the determination of the appeal at the Court of Appeal.
The letter was signed by Shaibu Enejoh Aruwa, SAN, on behalf of the law firm. Copies of the Notice of Appeal and the Motion on Notice for Stay of Execution were attached to the correspondence.
It is important to note that the filing of an appeal and an application for a stay of execution does not, in itself, amount to a court order suspending the judgment. The application is still awaiting the court's consideration.
